The new research is looking to see if assumptions made about whiplash injury claims are correct and that the Government's proposals with regard to medical evidence are likely to reduce insurance premiums.
"In my opinion, although there is clearly a need to the increasing number of often false claims under control, there are steps that could help useful – for example, flat rates for compensation and a number of benefits withheld and paid directly for treatment such as physical therapy," said Douglas. "Also historical claims must reflect the cost of treatment that patients have, or should have, run."
Douglas said he was also in favour of a system used in Germany and Austria, where collisions below a certain speed (reviewed by expert analysis of vehicle damage) are considered to cause a whiplash injury too low. CAR INSURANCE
"And, although I the concept of an independent panel to assess whiplash cases welcome, it is hard to see how they can come to a different diagnosis from those of a GP as such damages are not confirmed by conventional medical tests," he added.
Douglas said the civil justice reforms introduced in April will help cut injury claims costs.
These include rebalancing no-win no-fee listings to losing defendants no longer have to pay to the lawyer of the plaintiff success; prohibition on referral fees, and claims management companies offer incentives to make progress through to stop them.

Zurich, the Transport Commission research on whiplash claims praised and called for a joint approach by policy makers preparing reforms. CAR INSURANCE

Reinsurer to propose dividend at AGM CAR INSURANCE
Swiss Re has nominated former Association of British Insurers director general Mary Francis as a new non-executive independent director to its board for the next three years.
Francis was formerly a board member of the Bank of England, Aviva, Alliance Leicester and Cable & & Wireless. CAR INSURANCE
The board has also proposed the re-election or Walter Kielholz, Malcolm Knight, Carlos Represas and Jean-Pierre Roth for another three years.
The reinsurer will also propose a dividend of CHF 3.50 ($ 3.70) per share and a special dividend or CHF4 ($ 4.3) per share at its annual general meeting on 10 April, to be paid to shareholders on 11 April, returning a total of $ 2.8 bn to shareholders. CAR INSURANCE

Troubled Lloyd motor insurer Equity red star made a loss of £ 37.4 m for the year to 30 June 2012.
However, this is almost half the £ 45.9 m loss the company made in the previous financial year, a Companies House filing reveals. CAR INSURANCE
Equity Red Star, which is currently owned by Australian insurer IAG, its underwriting loss dropped to £ 4.6 m in its fiscal year 2011/2012 from CHF99. 9 m the previous year. This is a combined operating ratio of 103.5%, an improvement of 28.9 percentage points on 2011 the 132.4% produced.

The Committee on transport and tourism has started a study on how to cut the number and cost of whiplash claims. CAR INSURANCE
Louise Ellman said the Chairman of the Committee: "it is vital for policy makers to understand the reasons for the very high costs of motor insurance, especially for young drivers, and to take measures that cost. CAR INSURANCE
"Whiplash claims undoubtedly play a role in driving down the cost of motor insurance, but access to justice for injured people should be kept. We want to hear the arguments on these points and will publish a report in the summer over the best way forward on this difficult issue. " CAR INSURANCE

The Motor accident solicitors society (mass) has knocked the ABI proposal for medical panels to assess whiplash claims. CAR INSURANCE

Striker formally charged by the police
Manchester City striker Carlos Tevez (pictured) has been charged with driving without insurance and while disqualified, according to Cheshire police. CAR INSURANCE
The Argentine footballer last Thursday near his home in Alderley Edge was arrested and formally charged yesterday. He has been saved and will appear in Macclesfield Magistrates ' Court on 3 April.
In a statement, Cheshire police said: "Cheshire Constabulary has charged a 29-year-old man from Alderley Edge with offences of driving while disqualified and driving without insurance.
"The man was arrested on the A538 in Macclesfield at 5: 13 pm on Thursday 7 March and later released on police bail." CAR INSURANCE

Insurance Europe writes to EIOPA head warning ' unnecessary costs '
Insurance Europe trade body has written to the European Insurance and Occupational Pensions Authority (EIOPA) head Gabriel Bernadino opposing Solvency II interim quantitative reporting requirements and the warning that they are "unnecessary costs can result". CAR INSURANCE
The open letter was signed by Insurance Europe Deputy Director-General Olav Jones, said that if trialogue parties (the European Commission, Council and Parliament) were not in such measures, ran the risk of interfering with the policy-making process itself while the Omnibus II discussions are underway, and move forward on the result. Omnibus II is an important package of proposed amendments to the Solvency II directive. The content of Omnibus II is still under negotiation.
The letter said: "In these interim measures, it is essential that regulators aimed at limiting the cost of Solvency II for insurers and their policyholders, otherwise the cost of Solvency II long before the benefits will turn out, and there is a real risk that the project will fall into disrepute."
The letter said that only when the result of Omnibus II was known could go into what the focus, any interim measures must be applied to reporting. CAR INSURANCE
It said that this would depend on when Omnibus II is completed, what is decided, and the timetable for implementation.
"Even then the implementation should be done in the application with the principle of proportionality and a reasonable period to impose the necessary changes in their reporting processes and systems," said the letter. CAR INSURANCE
"It is important to recognize that interim measures are not a phasing of Solvency II, and that additional information collected during this period should not lead to other provisions than I is used to determine solvency capital requirements. The BGL group has hit BIBA's attitude on price comparison sites, calling them "total nonsense" and "prehistoric". CAR INSURANCE
Last week Biba chief executive Eric Galbraith said that the rise of aggregators had led to consumer buying too much based on price, and that this had increased claims and fraud.
BGL chief operating officer Matthew Donaldson (pictured) said: "I'm staggered on the inaccuracy of the Biba claims about price comparison sites makes-this view is absolutely prehistoric. Graeme Trudgill promoted to Executive Director of broker trade body
Biba has called compliance and training head Steve White as its next chief executive, replacing outgoing chief Eric Galbraith.
The designation follows a search performed by head-hunting firm Per Ardua, which began in November last year. CAR INSURANCE
The real estate agency trade body has also promoted corporate affairs head Graeme Trudgill to the position of Executive Director, reporting to white. BIBA's main board going to make due Trudgill.
White and will assume their new positions from May 1, Trudgill.
White and Trudgill were understood to be in the running for the top job at Biba. Although Per Ardua had performed a search for a new chief within and outside the Organization, it was considered likely that the top job would go to an insider. CAR INSURANCE

CAR INSURANCE Berkshire to take 7.5% of Aon of Lloyd's business in new side-car deal

Aon McGill says that more cases can be placed with Lloyd's
Berkshire Hathaway is a 7.5% share of all Aon Risk Solutions ' Lloyd 's-related matters under a groundbreaking new sidecar deal announced today.
The deal is believed to be worth around $ 200 m in annual gross written premium to Berkshire Hathaway's UK arm, Berkshire Hathaway international insurance.
The sidecar will write 7.5% of all Aon Risk Solutions eligible Lloyds-related business. The agreement includes all eligible subscription lines, including ownership and accident, power and construction, marine and energy and financial/executive liability.
Aon Risk Solutions said that the estimated 10,000-plus customer base would get access to Berkshire Hathaway AA + rated capacity. CAR INSURANCE
The President of the group, President and chief executive Steve McGill said the deal was likely to result in Aon to place more business with Lloyd 's.
He said: "this landmark solution offers a unique way for our customers access to high-quality capacity efficiently. No other company has passed a resolution of this scale to their retail clients on all segments of the industry on the basis of full follow. We are proud to offer our customers unprecedented access to the financial strength of Berkshire Hathaway with this transaction. "
The settlement covers all geographical regions and segments, but closes without subscription company such as aviation and space, and reinsurance and retrocessional insurance.
A spokesman for Aon said that there are no limits in terms of capacity commitment or stroke weight to each individual risk, including natural disaster exposure. CAR INSURANCE
He said the deal would improve the speed of business placement with Lloyd's and would apply to all business connected on or after 31 March.

Ipswich man caught trying to claim against Groupama
A man who tried to cheat Groupama by making a false claim for a vintage Bentley has been fined £ 10,000 after a survey by the insurance fraud enforcement Department (IFED).
Peter Michael Webb, 56, of Richmond Road, Ipswich, insured a Bentley Mark V1 for £ 42,000 after saying he had spent £ 38,000 in cash recovering scrap.

New proposals to reduce whiplash epidemic
The ABI wants whiplash injuries are checked by a licensed medical professional, under new proposals unveiled today.
The insurer trade body said 1,500 people claim whiplash injury every day.
Recent figures from the Ministry of Justice consultation document December said that 70% of UK road accident personal injury claims for whiplash.
This compares to 47% in Germany, 32% in Spain and 3% in France.

That medical evaluation of whiplash claims would be conducted by a licensed medical expert. They would have to give their financial independence of plaintiff lawyers, take into account the circumstances of the collision instead of the plaintiff reported symptoms and trained in the latest techniques of diagnosis. Accreditation would be conducted by a Board of Directors composed of the Government, the judiciary, plaintiff interest groups, expansion joints and medical experts. The Board of Directors the accreditation process would develop and standardized medical reports, and arrange for the plaintiff whiplash to be examined. The small claims track threshold would increase from £ 1,000 to £ 5000 for all road traffic personal injury claims. Networks partnership ends after both sides failed to agree on renewal terms
Aviva will no longer participate on Willis Networks insurer Panel after deciding against extending an existing agreement with the broker.
It is the second major network deal that Aviva has ended in less than a year. Last June, the insurer terminated his partner status with Towergate-run insurer Broker network because it argued that not enough money from the arrangement.

The insurance fraud Bureau (IFB) and the Association of Chief Police Officers (ACPO) have agreed to share intelligence on organised criminal gangs.
A formal intelligence sharing agreement was signed today by IFB head of intelligence Stephen Dalton and the Chief Constable of Durham constabulary, Michael Barton, on behalf of ACPO.
